Copyright on an oil painting done from a photo?
My boyfriend painted a pretty oil painting of a butterfly and is intending to make prints for friends and family. The painting was done from a photograph which he saw in a calendar. I assume that there's no copyright disobedience if the prints are just for personal use, but can he legally sell prints of his painting?
Is making money from a painting based on a photo an infringement of the photographer's copyright?
The homely answer is yes, it is infringement. The legal interpretation of "substantially changed" that is applied to a derivative occupation of art from a copyrighted work is so subjective that it is wise to avoid making this mistake.
It is important to note that most art shows, exhibitions, contests, and galleries also rule out any work that violates the copyright law. I have even heard of suits filed over copyright when the holder of the original design copyright fitting happened upon the derivative work on display in a gallery or online.
Best to take your own photos, so you can prove that the idea was your own --- from formula to color to incredible subject matter.

Your apeture extent and shutter speed won't effect the glare from oil. The amount of fill flash used will dictate the level of glare. If using an add-on shoot have it set to the lowest level possible to allow for a proper exposure.
I painted(oil) a photo (altered it) from a newspaper and want to sell it, any copyright infringements in that?
The photo is from a college football encounter and I selected two players from the pack and painted them only. A couple of people have seen the painting and want me to duplicate it for them to purchase. I'm not dependable if the photo is copyrighted(it is not marked as such) or if the fact that I altered it slighty makes it ok for me to sell it. Any information would be greatly appreciated.

There is in truth partial copy right infringement possibilities. Just changing the medium or altering it slightly wont cut it. I lean to follow the 40/60 rule. You must alter the image to at least 60% past original, it can't just be a ungenerous change here and there, it must be a large enough basis where when the images are held together, you can clearly see yours is a new photo. But, all that aside, as long as your image is not republished (ex. surreptitiously collection) no body will really care. Also, the best way to reproduce an already painted image, is to have a print made on canvas from a specialty inform on, it can cost up words of $15-$100 an image, depending, but the quality is out standing. The technical name begins with a G I just cannot remeber it reason now.
